Officers in violent New Jersey beach arrest won't face criminal charges

She's not the person she was made out to be, she says. One situation doesn't define someone.

Cellphone video shows one of the officers repeatedly punching Weinman in the head while restraining her. Police said Weinman hit an officer first.

The original video recorded by a bystander depicted an officer wrestling her to the ground, as well as hitting her twice before wrestling her to the ground again.

Appearing Wednesday on ABC's "Good Morning America", 20-year-old Emily Weinman said her neck and back were hurt in the confrontation in Wildwood. Weinman said she does not need to apologize for her actions to police.

She denied striking the officer, and said if she kicked the officer, it was "after the fact". So when they got me on my stomach, after I was struggling trying to defend myself, I spit the sand out of my mouth which made it look like I was spitting at the officer.

But Weinman refused to give the officer her name.

When asked why she didn't give her name when asked, Weinman said she didn't see the point in it.

Her attorney, Stephen Dicht, jumped in when Weinman was asked why she didn't just submit to an arrest an argue it out in court later.

The Primaries Were Important Last Night - Here Are The Key Takeaways
Ivey, who stepped into the governor post after the resignation of Robert Bentley a year ago , will seek a full term in November. It was a big night for women, including a Democratic former Navy pilot running for a House seat in New Jersey .

The Cape May County prosecutor on Tuesday said the officers would not face criminal charges.

Weinman also said the containers of alcohol in their possession were sealed, contradicting the allegations against her.

"The Saturday she was taken into custody, she was in custody for about 40 minutes, she was charged with misdemeanors". He hadn't told her 'I'm going to issue you a summons.' He hadn't told her any of those things.

But the officer told her she still could not have the alcohol under 21.

The bodycam video shows Weinman walking away from the officers, with one warning her that she is "about to get dropped". "When he smashed my head into the ground, I got sand in my mouth". Weinman then is seen spitting toward the officers.

"I recognize that the video footage has raised a lot of questions regarding the officers' actions", Cape May County Prosecutor Jeffrey H. Sutherland said in a statement.

The goal of the preliminary investigation was to determine whether the Professional Standards Unit ("PSU") of the Cape May County Prosecutor's Office would conduct the Internal Affairs investigation based on possible criminal charges against the arresting officer (s), or whether the Wildwood Police Department would conduct an Administrative Internal Affairs Investigation. A decision such as this is not based on emotion; it is based upon applying the proper laws, policies and directives that govern law enforcement.
